On November 5th, 2024 at the Walmart on Tower Road, a man who goes by Toni Tone on social media was being brutalized and by the APD during an arrest. Throughout the duration of the vicious attack, Toni can be heard repeating “I can’t breathe” many times over. His cries were ignored and the brutalization continued. Toni had a right to be free from unlawful detention and excessive force. What happened to him was a serious violation of his constitutional rights and a violent crime against his person.
Te’Erica Mosley, not content with being a bystander, made the brave decision to record this brutalization using her phone. Officers, who wanted to prevent her from collecting evidence of their crimes, quickly swarmed Te’Erica. When she heroically stood her ground and exercised her right to film the officer’s misconduct, she too was brutalized badly enough to require extensive hospitalization. To add insult to injury, the police charged her with a felony claiming that she assaulted the police who hospitalized her. All this can be clearly seen on the body camera footage available on our YouTube channel.
That’s not where the injustice ended for Te’Erica, unfortunately. As is all too common for Black women, while in the hospital, Te’Erica suffered life-threatening medical neglect. Hospital staff tried to prematurely discharge her over her own objections and insistence that she needed further care. Hospital staff, in horrific disregard for Te’Erica’s well-being, tried to use physical force to remove her. Te’Erica, who asserted her right to complete and quality care from her medical provider, was again charged with assault.
Thanks in no small part to the support of community members, we’re happy to say that Te’Erica’s felony assault charges from the initial APD attack have been dropped! Her attorneys are confident that, with continued pressure, her misdemeanor charges from the hospital will also be dropped. When the community shows up for those facing false charges, it sends a strong message to the judge that there are people who care about this person, and that we aren’t going to stand idly by while charges are stuck on somebody who did the right thing. We at DACAC understand that Te’Erica Mosley stands on the right side of history; she stands with the people facing police brutality and oppression. We’re going to stand with her and demand that she gets justice. Not just in the fight to drop these bogus charges, but to see the police involved in the brutalizations that occurred that night held to account for their crimes.
Hello, my name is Shamika Tuggle, and I am the proud mother of Te’Erica Mosley, an unsung hero with a camera. We live in Denver, Colorado, but were at a store in Aurora, Colorado, an All-American city with a particularly heinous police department. This police department is known to employ brutal and lethal force on its citizens. Their own numbers indicate that they had 757 use-of-force incidents in the last year alone. I am coming to you because my daughter, Te’Erica Mosley, is now one of those victims.
But she survived.
As we were leaving a store on the evening of November 5th we heard a man screaming “I can’t breathe.” Seeing about 10-15 Walmart employees standing at the entrance yelling at the officers. I asked Te'Erica to start recording. He had his hands in the air, no shirt on, it's snowing and he's hollering he can't breathe and begging for water. The amount of force that was being used on this young man was beyond excessive. He became surrounded by police officers and we could count around 11 cruisers. They were brutalizing this man. As Te'Erica, was still recording this incredibly brave act to record and bear witness.
When one of the officers walked over and punched her in the face. She fell back onto my cart. I pushed her up and in the same motion the officer picked her up and body slammed her to the wet snowy ground and a few of the officers, including the one who attacked Te’Erica, then detained her bringing her back to one of their cars as she was having a seizure. Te’Erica, like myself, is disabled.
Te’Erica has been in and out of the hospital since. Her actions on November 5th were not only legal, but the responsible ones to take.
Now, my daughters and I have to contend with hospital bills, as well as the everyday struggle of feeding our family. Every donation you make will help us fight this battle.
